Terms of service
The agreement for using Emoto Marketplace by Riot Racing.
Who we are and how to contact us
Emoto Marketplace by Riot Racing, available at emotomp.com, is operated under the Riot Racing business name (“Riot Racing,” “we,” “us”). These terms cover this marketplace, not a separate retailer’s website or services. Contact the operator at riotracing23@gmail.com, with “Emoto Marketplace” in the subject, or through Support. Do not send legal notices to our automated sign-in sender. No separate corporate or limited-liability entity is represented by the marketplace name.
Acceptance, scope, and early access
Effective September 12, 2026, version parts-2026-09-12-v4. Read these terms before accepting them. You accept by affirmatively checking the agreement and completing sign-in, policy acceptance, seller onboarding, or an order as applicable. Merely visiting a public page does not record contractual acceptance. The seller agreement applies when you sell; buyer, fees, shipping, returns, prohibited-items, safety, community, and AI policies apply to the activities they describe. Our privacy and cookies policies explain information practices. Account creation, listings, and messaging are available during early access. Live checkout and payouts remain closed. Test transactions are simulations, not sales.
Eligibility and account responsibility
You must be at least 18, legally able to contract, and located in the United States to hold an account. Only individual U.S. sellers offering their own used e-moto parts are supported. Do not impersonate someone, provide false verification information, use another person’s account, or create accounts to evade restrictions. Keep your email and security methods secure and notify us promptly of suspected misuse. You are responsible for your authorized activity; responsibility for unauthorized activity is determined by the facts and applicable law, not an automatic transfer of every loss to you.
Our role and the sale contract
Independent sellers supply, describe, price, package, and ship their parts. We provide the marketplace and its account, communications, payment, and dispute tools. A sale is between the identified buyer and seller, subject to obligations the law places on Riot Racing itself. We do not take physical possession of ordinary seller inventory. A seller’s listing, AI result, or platform status is not our mechanical inspection, endorsement, authenticity certificate, road-use approval, insurance, or warranty. We do not disclaim duties the law imposes on a marketplace, distributor, service provider, or payment participant.
Orders, prices, and communications
Use the marketplace’s supported checkout and order communications. An unpaid order does not complete payment or permanently reserve a part. Availability and prices are checked again at checkout. A confirmed charge, not a browser animation or seller message, establishes payment. Review all disclosed totals before authorizing payment. We may refuse or correct an obvious error before a sale; if a paid order cannot be fulfilled, the applicable cancellation and refund process applies. We will not increase an accepted charge without authorization. Service emails concern your account, security, orders, or policy changes; accepting these terms is not consent to unrelated marketing.
Your content and our intellectual property
You retain ownership of your original photos, text, and other content. You grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, resize, display, and process that content through service providers as needed to operate, secure, moderate, and support this marketplace and resolve associated claims. This is not ownership of your work or permission to use private messages in advertising. The license ends when content is removed except for legally retained records, existing transaction evidence, backups during their retention cycle, and uses already lawfully made. Riot Racing branding, site code, and design remain protected; third-party brands identify products or fitment and do not imply affiliation.
Acceptable use and enforcement
Do not sell prohibited goods, infringe rights, harass people, solicit outside payments, harvest personal data, bypass access controls or rate limits, exploit vulnerabilities, upload malicious code, or manipulate AI checks with concealed instructions. We may limit, remove, pause, or suspend activity when reasonably necessary for safety, suspected fraud, policy violations, legal obligations, or service integrity. Where appropriate, we explain the reason and permit a support appeal; urgent protective action may occur first. Suspension does not erase an earned refund, existing order duty, privacy right, or right to challenge our decision.
Used-part risks and service warranties
Used mechanical and electrical parts can have hidden defects and can cause serious injury or property damage if incompatible, damaged, or improperly installed. Inspect parts and obtain qualified technical advice before use. To the extent permitted by law, the marketplace service is supplied as available without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not promise uninterrupted service or error-free AI. These service disclaimers do not excuse a seller’s misdescription, displace any express promise we actually make, or remove warranties and remedies that cannot lawfully be excluded.
Limits of liability
To the extent permitted by applicable law, Riot Racing is not liable for indirect, incidental, special, consequential, or punitive losses arising from marketplace use, such as lost profits or business opportunities. For claims about the marketplace service, our aggregate liability is limited to the greater of $100 or marketplace fees you paid or that we retained from your transactions in the 12 months before the event giving rise to the claim. This limit does not reduce amounts we are required to refund or remit, and does not apply to our fraud, intentional misconduct, gross negligence, personal injury or death caused by our negligence, or any liability, statutory remedy, or consumer right that cannot legally be limited. If a restriction is unlawful in your jurisdiction, it applies only to the extent lawful.
Responsibility for third-party claims
To the extent permitted by law, you agree to reimburse Riot Racing for reasonable losses, damages, and legal costs of third-party claims caused by your unlawful listing or content, infringement of another person’s rights, fraud, or material breach of these terms. This obligation applies only to the extent caused by your conduct and does not cover Riot Racing’s own negligence, wrongdoing, or nondelegable duties. We will give reasonably prompt notice, allow reasonable participation in the defense, and will not settle a claim in a way that admits fault for you or imposes a nonmonetary obligation on you without your consent.
Disputes and protected rights
Contact Support with the facts and desired resolution so we can try to resolve a dispute. Informal assistance does not prevent timely court action, a payment-provider dispute, reporting to a regulator, or seeking urgent relief. Applicable United States federal and state law governs according to the court’s normal choice-of-law rules, with mandatory protections of your home jurisdiction preserved. These terms do not impose mandatory arbitration, an exclusive distant forum, a class-action waiver, a shortened statutory filing period, or a ban on honest reviews. Future dispute terms require a separately disclosed prospective update; they do not retroactively remove accrued rights.
Changes, termination, and general provisions
We publish the effective date, version, and a summary of material changes and request renewed acceptance for new account activity. We will give any additional notice or obtain any consent required for a material change. Existing orders remain subject to the terms recorded for them unless a lawful, expressly accepted change applies. You may stop using the service and request account closure; outstanding transactions and lawful record retention still apply. Invalid provisions are limited or separated without discarding the remainder. Failure to enforce one provision is not a permanent waiver. Neither party may transfer obligations to avoid consumer rights; a lawful business transfer remains subject to the privacy policy. These terms and applicable transaction policies form the agreement for this service; statutory rights prevail over conflicting text.
Privacy policy
What we collect, who receives it, and how to exercise your rights.
Who is responsible and when this applies
Riot Racing operates Emoto Marketplace and is responsible for the marketplace information described here. Effective September 12, 2026. Contact riotracing23@gmail.com with “Privacy — Emoto Marketplace,” or use Your privacy choices. This notice covers visitors, applicants, account holders, sellers, buyers, and people contacting support. Separate payment-provider notices also apply when you use their services. We do not claim that every state privacy law applies to this small business; we honor rights that do apply and offer a request channel to everyone.
Information you provide
We collect your email and account-verification information; username, display name, biography, profile picture, and city/state; listing descriptions, fitment, prices, and photos; messages, including submissions stopped by a filter; reports and support correspondence; and your policy acceptance version and time. If purchasing is enabled, we collect the delivery name, address, phone, order details, tracking, evidence, and dispute correspondence. Do not put government IDs, financial credentials, medical information, verification codes, or someone else’s private information in listings, messages, or support forms. Stripe collects payment, bank, identity, and tax details directly when its onboarding or checkout is available.
Technical information and sources
Information comes from you, your browser, transaction partners, service providers, and staff activity. Hosting and security services may process IP addresses, browser/device details, request URLs, timestamps, errors, and abuse signals while delivering and protecting the site. The application stores limited security credentials in hashed or encrypted form, challenge and session expiry information, attempt limits, and administrative audit records. We do not use browser geolocation, face recognition, a biometric identity database, advertising profiles, or session-replay tools in the current release.
Why we use information
We use information to authenticate accounts, publish and find parts, provide messaging, process and fulfill authorized orders, verify delivery, administer payouts and refunds, prevent abuse, enforce policies, respond to requests, maintain security and operational records, and comply with applicable legal, accounting, and dispute obligations. We use the information needed for each purpose. Public profile fields are for marketplace identity; delivery details are for fulfillment. We do not use private messages as advertising testimonials or authorize sellers to market to buyers using their shipping details.
What other users can see
Usernames, display names, avatars, biographies, city/state, and published listing information are public. Public images can be copied by others or cached outside our control. Drafts and unlinked uploaded images are restricted to their owner and authorized staff; published listing images become publicly accessible. The buyer and authorized staff can see checkout details; the seller receives delivery details after payment for fulfillment. Message participants can see sent messages; a blocked message is visible to its sender and authorized reviewers, not delivered to the other participant. We cannot retract screenshots that someone already made, but can address misuse on our service.
Service providers and other disclosures
We use OpenAI Sites and its Cloudflare infrastructure for hosting, database, media storage, and technical operations; Resend for account emails; OpenAI’s API for listing checks; and Stripe for payment, seller onboarding, and payout functions when enabled. Providers receive information needed for their services under applicable arrangements. Our authorized staff can inspect account, listing, support, and transaction records as needed. We may disclose relevant information for a valid legal request, fraud or safety investigation, rights enforcement, or a lawful business transfer with appropriate safeguards. We do not publish account email addresses, payment credentials, or delivery addresses as public seller-profile fields.
AI processing and automated decisions
When you submit a part, listing text, part details, and uploaded photos are sent to OpenAI for content screening. We do not deliberately include account emails, payment records, or shipping addresses in the request; information you put into a photo or description can nevertheless be included. We store the assessment and review history. We request nonstorage of the response for later retrieval, but this does not mean zero provider retention: security, abuse-monitoring, legal, and image-related exceptions can apply. OpenAI states that API data is not used for training by default unless the customer opts in; this notice is not a claim that we have an approved zero-retention arrangement. Clean checks can publish a listing automatically. Other results leave it private. AI may be wrong; contact support for a human reconsideration. Messages currently use application text filters, not the listing-image AI review.
Cookies, sale, sharing, and advertising
We currently use essential account, sign-in, and verification cookies and no optional advertising pixels, cross-site marketing analytics, or session replay. We do not sell personal information or share it for cross-context behavioral advertising in the current release. A Global Privacy Control signal does not enable any additional tracking; there is no advertising sale/share processing to switch off. If optional tracking is introduced, we must update disclosures and implement required opt-out or consent controls before using it. Our cookies policy explains the current browser storage. A general browser Do Not Track signal does not change essential security processing.
Retention and removal
We retain active account/profile and listing information while needed to provide the service, and retain transaction, agreement, security, moderation, and dispute evidence when necessary for the associated purpose or a legal obligation. Retention depends on open transactions, suspected abuse, requests, applicable limitation periods, and accounting or legal requirements. Account sessions expire after 12 hours and login challenges after 10 minutes; expiry ends their validity and is not a promise that every database or backup copy disappears immediately. Expired login records are pruned during successful sign-in. Other deletion and retention reviews are currently handled by staff; universal automatic deletion is not active. When you request deletion, we assess removable records, retained exceptions, and provider copies and explain relevant limits. We do not retain data merely to justify a future unrelated use.
Your requests and choices
You can edit profile information and pause eligible listings in your account. Request access, a portable copy, correction, deletion, closure, processing information, or an applicable opt-out at /privacy or riotracing23@gmail.com; you do not need an account to email us. State your request and the email associated with your account. We verify proportionately, normally using your account or email, and do not ask for passwords or sign-in codes in a message. An authorized agent can contact us with evidence of authority; we may verify with you. We respond within applicable legal deadlines, explain permitted refusals or extensions, and do not unlawfully discriminate for exercising rights. To appeal, reply with “Privacy appeal” and the request reference. You may also contact the relevant state regulator.
State rights and necessary exceptions
Depending on where you live and which laws apply to us, rights may include knowing data categories, sources, purposes and recipients; access and portability; correction and deletion; and opting out of sale, targeted advertising, or specified profiling. We do not currently use personal information for targeted advertising or make credit, employment, housing, or insurance eligibility decisions. Essential fraud prevention and listing moderation are described separately and can be challenged through support. Deletion may be limited for completing an order, protecting others, tax/accounting duties, security, or a legal claim; any retained data remains restricted to its permitted purpose. We will supply information required by an applicable state notice requirement rather than treating this paragraph as a waiver.
Security, children, and processing locations
We use HTTPS, access controls, limited staff privileges, secure session handling, and optional authenticator protection. No system is perfectly secure, and we do not promise absolute security or certify regulatory compliance. Notify us about a suspected exposure so we can investigate and provide any notices required by law. Accounts are for adults 18 and older; the service is not directed to children under 13 and we do not knowingly collect their personal information. A parent or guardian can contact us to address a child’s information. Providers may process information in the United States and other countries; we do not promise U.S.-only data residency.
Policy changes and related notices
The policy hub provides current versions and available archives. Material changes will be disclosed with the notice or consent required by law. An update does not authorize an incompatible new use of previously collected information merely by changing a page. See the cookies, AI review, security, and intellectual-property policies for additional details. Acknowledging this notice confirms receipt; it is not a waiver of privacy rights or blanket consent to future processing.
Individual seller agreement
Your listing, fulfillment, fee, and payout responsibilities.
Acceptance and eligibility
You must be an adult U.S. individual selling a part you lawfully own. By explicitly accepting this agreement, you also accept the marketplace terms and applicable shipping, returns, fees, prohibited-items, safety, community, and AI policies and acknowledge the privacy notice. We record the version and acceptance time. Material changes require renewed acceptance before new listing submissions or payout onboarding. Do not use an individual account for undisclosed dealer, consignment, new-stock, or stolen-goods activity.
Accurate used-part listings
List used aftermarket parts or original take-offs, not complete bikes or new retail stock. State the actual manufacturer/model, known compatible years, dimensions, mounting standards, adapters, included hardware, missing pieces, use, repairs, wear, and defects. Mark unknown information as unknown. Do not claim authenticity or universal compatibility without a basis. Reference images and screenshots must match the item and be lawfully usable; disclose actual condition and defects even when reference imagery looks new. Actual-item photos are strongly recommended. Own and keep available the item you list; do not duplicate it to sell it twice.
Safety and rights warranties
You represent that you may legally sell the part and use the listing content; it is not stolen, counterfeit, recalled, prohibited, or known to be dangerously defective; and your material descriptions are accurate. A label such as as-is, untested, or for parts does not permit a prohibited item or concealment. Check recalls and retain reasonable ownership evidence. Report a newly discovered safety concern immediately, pause the listing, and cooperate with necessary notices, removals, returns, or refunds.
Price, fee, and payment authorization
Listing is free. The marketplace commission is 9% of the item price, rounded to the nearest cent, excluding shipping and tax. Seller proceeds are the item price less commission plus the buyer’s shipping charge, subject to disclosed lawful adjustments, refunds, and payment disputes. Ordinary processing costs are covered from our commission; no additional seller charge is imposed without advance disclosure and authorization where required. You authorize the payment provider and Riot Racing to collect authorized payments, apply the disclosed commission, and transfer proceeds according to the fees and returns policies. You remain responsible for packaging and carrier costs upfront.
Shipping commitment
Ship the exact described part and included items to the checkout address using an appropriate tracked service within five business days after confirmed payment, unless a different lawful dispatch date was expressly agreed before purchase. Never request an extra outside payment. If the commitment cannot be met, contact Support before it expires so the buyer receives the required delay-consent or cancellation/refund options. A created label is not proof of carrier acceptance. Retain tracking, packaging, and delivery evidence; use shipping services that lawfully accept the contents.
Delivery-based settlement
Proceeds are not transferred to the seller before independent carrier-delivery verification for the checkout destination, a 48-hour inspection period measured from recorded verification, and clearance of open issues. Staff currently verify delivery evidence and release eligible transfers; entering a tracking number does not release funds. Stripe onboarding, settlement, reserve, risk, and bank requirements may delay availability. This is deferred marketplace settlement, not a licensed escrow, deposit, insurance, or guaranteed bank-arrival service. Funds may be held only for a legitimate disclosed transaction, risk, legal, or provider reason.
Refunds, disputes, and cooperation
Respond to reasonable evidence requests promptly, normally within two business days, and ask for more time if necessary. You authorize justified refunds and payment-provider reversals attributable to your sale, with the decision and basis communicated. A prior payout does not eliminate a valid buyer remedy; amounts lawfully owed may be recovered through available provider processes or a separate lawful claim. This agreement does not authorize an undisclosed new debit to your bank account. Riot Racing remains responsible for its own acts and duties. Either party may request review; statutory and payment-provider rights remain available.
Buyer information and taxes
Use a buyer’s name, phone, address, and messages only to fulfill and support the transaction or comply with law. Do not publish, sell, add them to marketing lists, or contact the buyer to harass them. Keep Stripe identity and tax information accurate. You are responsible for your income-tax obligations; marketplace sales-tax collection and any reporting are allocated under applicable law, not shifted away from the platform by this agreement. Payment onboarding is through Stripe; do not upload tax or identity documents here.
Buyer policy
Check fitment, review totals, and inspect the part when it arrives.
Before buying
Read the full description, included items, fitment, mounting standards, model/part number, and known damage. Screenshots or reference images do not prove the condition of the individual used part; ask for current photos when needed. A brand or fitment filter, an AI-cleared status, or a professional-looking listing is not a compatibility, safety, or authenticity guarantee. Use in-app questions and obtain qualified advice for safety-critical components.
Your order
Use your own verified account and a correct supported U.S. shipping address. Review the item, shipping, and applicable tax total at checkout. Pay only through the marketplace’s authorized payment flow; no local pickup or outside payment. An unpaid quote is not a completed purchase and may expire. We do not currently offer live purchasing, installments, a wallet, PayPal payouts, or a guaranteed buyer-insurance program.
Delivery and inspection
Inspect the packaging and part before installation. Preserve photos and packaging and report non-delivery, damage, missing items, or a material mismatch through the order. Payout eligibility starts no sooner than independent delivery verification plus a 48-hour inspection window. That window is a settlement control, not a deadline that extinguishes legal, warranty, or payment-provider claims. A report on your order places payout on hold while it is assessed.
Responsible use and remedies
Do not install, energize, ride with, alter, or resell an apparently unsafe part. A qualified technician may be required for brakes, steering, suspension, wheels, or electronics. Requests for a refund or return are reviewed under the returns policy and applicable law. Honest evidence is required; fabricated claims, swapped returned goods, threats, or duplicate reimbursements are prohibited. Report an existing payment dispute so we can coordinate without restricting your right to pursue it.
Fees and seller payouts
The seller commission, shipping amounts, and timing of funds.
Marketplace commission
Listing is free. The seller commission is 9% of the item price, rounded to the nearest cent; shipping and tax are excluded. For a $200 part plus $15 shipping, the commission is $18 and the seller proceeds are $197 before a lawful refund or adjustment. The seller pays the carrier and packaging costs. Buyers see their applicable order total before payment. There is no subscription or recurring listing fee in this release.
Processing, tax, and changes
Ordinary card-processing costs are paid from Riot Racing’s commission. We do not silently add exceptional fees or increase an accepted order price. Tax, where required, must be shown at checkout and handled under applicable marketplace-facilitator rules. Live tax collection is not activated in the current test-only checkout. Fee changes are disclosed prospectively with any required renewed agreement; existing order fees are not retroactively increased.
Where funds go
The implemented payment design uses Stripe Connect Express and separate platform charges and seller transfers. A buyer pays through marketplace checkout. Eligible net proceeds transfer only after independent delivery verification, the 48-hour inspection period, and resolution of holds. Stripe then pays the seller’s connected bank account under its requirements and timing. A transfer and a bank payout are different events. Availability may depend on settlement, verification, reserves, chargebacks, and provider restrictions. PayPal is not connected.
Holds and refunds
A pending or disputed sale is not immediately withdrawable. We communicate relevant holds and resolve them through the returns process. Approved full refunds return the item amount and original shipping, including the marketplace commission attributable to the refunded sale, through the original provider; tax refunds must follow applicable rules when live tax collection is enabled. Bank posting times vary. The current interface supports full refunds, not negotiated partial-refund processing. Provider fees and negative-balance exposure borne by Riot Racing do not become an undisclosed customer charge.
Current availability
Real checkout and payouts are closed while business verification and payment activation are completed. Test displays do not represent money available for withdrawal. Riot Racing does not offer interest-bearing balances, stored-value accounts, licensed escrow, payment insurance, or a guaranteed payout date. Any later payment feature requires its actual implementation and updated disclosures.
Shipping and delivery
Tracked U.S. shipping, dispatch expectations, and delivery evidence.
Supported destinations
The marketplace supports the 50 U.S. states and Washington, DC. International destinations and territories are not supported. There is no local pickup. Sellers must select a service that serves the checkout destination and set a shipping price they can honor, including Alaska or Hawaii where applicable. Contact Support before a transaction if a destination cannot be served; do not request additional payment after checkout.
Dispatch and packaging
The seller’s default commitment is dispatch within five business days after confirmed payment, unless a different lawful date was expressly agreed before purchase. Ship the exact described item and included hardware to the checkout address. Protect sharp edges, mounting surfaces, and fragile components, secure loose pieces, and follow carrier size, weight, and contents rules. Obtain a carrier acceptance scan and keep a receipt. A label creation event alone does not establish shipment.
Restricted contents and insurance
Batteries, battery packs, loose cells, hazardous fluids, and other prohibited dangerous goods are excluded. Verify carrier preparation rules for items such as suspension components; never misdeclare contents or use an incorrect classification to bypass restrictions. Shipping insurance exists only if actually purchased and accepted by the carrier; our platform does not provide automatic shipping insurance. Coverage terms do not eliminate the seller’s fulfillment responsibilities.
Delays, loss, and address issues
When dispatch will be late, contact Support promptly with a realistic revised date. The buyer must receive legally required delay notice, an opportunity to consent, and cancellation/refund options; silence is not blanket consent to indefinite delay. Lost, damaged, or misdelivered parcels require investigation and applicable remedies. Tracking entry or elapsed time alone never makes seller proceeds releasable. Address changes after payment require support review; do not redirect shipments based only on a chat message.
Verification and inspection
Staff currently check independent carrier evidence against the order destination, record the result, and start the 48-hour inspection window at verification. A participant cannot verify their own delivery through the staff release workflow. An order report creates a hold. Carrier-feed automation and in-app label purchase are not currently offered. The inspection window does not shorten statutory or payment-provider rights.
Returns, cancellations, and disputes
How to report a problem, request a refund, and challenge a decision.
Cancellations
An unpaid order does not charge your card. After payment, submit an order request as soon as possible. Support checks whether fulfillment can be stopped and communicates the decision. A request is not confirmation that cancellation or a refund is complete. Where shipment is not made as promised, the required delay-consent and refund rules apply. Sellers cannot keep payment for a sale they cannot lawfully fulfill.
Order problems
Report non-delivery, shipping damage, missing included parts, counterfeits, recalls, or a material difference from the listing. Inaccurate seller fitment information may be a material mismatch; a buyer choosing a clearly disclosed incompatible part is different. Provide a factual account and preserve the part, packaging, photos, tracking, and correspondence. Do not send sensitive documents or fabricated evidence.
Mediation and holds
A report by a participant about their order puts it on hold. Staff seek relevant information from both parties, record a reasoned outcome, and communicate any return/refund instructions. Please respond within two business days or explain why you need more time. We do not currently promise a staffed response deadline. Closing a report does not itself release funds; open issues and payment disputes must be resolved and an independent staff member must verify release eligibility.
Returns and costs
There is no automatic change-of-mind return for a correctly described used part unless expressly agreed or required by law. This does not excuse misdescription, non-delivery, or an unlawful sale. For an approved return, obtain the destination, timing, packaging, tracking, cost responsibility, and refund conditions from Support before sending it. Seller-caused errors should not result in an undisclosed return cost imposed on the buyer. Do not mail unsafe contents until the carrier accepts the method. Preserve condition and included items; reasonable inspection is different from damaging or substituting a part.
Refunds and appeals
Approved full refunds use the original payment method for the collected item price and original shipping; legally due tax is addressed when tax collection is enabled. Partial refunds are not available in the current interface. Refund posting depends on the bank/provider. A seller recovery problem does not erase a justified buyer remedy. To appeal, contact Support with the order reference and the overlooked evidence. The 48-hour inspection period is not a waiver of later legal claims. You may contact your payment provider or a regulator, seek lawful court remedies, and post honest reviews; no policy penalizes those actions. Duplicate reimbursement for the same loss is not permitted.
Prohibited items and listings
Only lawful used e-moto parts belong here.
Outside this marketplace
Do not list complete bikes, new retail inventory, dealer inventory, unrelated consumer goods, services, financing, tickets, gift cards, accounts, or international offers. Only used aftermarket parts and accurately described original take-offs are accepted. Batteries, packs, loose cells, hazardous fluids, and prohibited dangerous goods are excluded.
Weapons, sexual products, and drugs
No firearms, ammunition, weapon components or accessories, explosives, devices intended to injure people, sexual products or sex toys, pornography or explicit sexual content, illegal drugs, controlled substances, drug paraphernalia, tobacco, or vaping products. Hiding one of these in a part photo, euphemism, accessory bundle, or misleading category does not make it permitted.
Stolen, infringing, and unsafe goods
No stolen goods, counterfeit products, removed or altered identifying numbers, undisclosed liens or ownership claims, recalled items, dangerously worn or cracked structural parts, bent steering/suspension, defective brakes, fire/flood-damaged electronics, or other known dangerous components. “As-is,” “untested,” and “for parts” do not override these rules. Do not list a product that you cannot legally own, ship, or transfer.
Listing conduct
No misleading claims, hidden defects, unrelated photos, private information, outside-payment solicitation, malicious links, harassment, discriminatory exclusion, artificial endorsements, or content used without rights. Screenshots and manufacturer/reference photos may be used only when they match the offered part and you have permission or another lawful basis. Do not imply that reference imagery is a current photo of the actual used item. Incidental store interface in an otherwise allowed screenshot is not automatically a prohibited solicitation.
Checks, removals, and reports
Text filters and AI screen submitted listings. Complete clean checks may publish automatically; other results stay private. Checks can miss problems or flag legitimate parts. We can remove a live listing after a report or new evidence and restrict an account for serious or repeated abuse. Report the listing or contact Support for safety, rights, or moderation concerns. Human reconsideration is available; permission to sell a prohibited item cannot be obtained by evading the checks.
Used-part safety and recalls
Fitment, inspection, installation, and reporting dangerous parts.
Safety-critical parts
Brakes, forks, suspension, steering, wheels, drivetrains, and electrical components can fail and cause serious injury, death, or property damage. Used parts may have hidden damage and incomplete history. Inspect the actual part, check specifications and manufacturer instructions, and obtain qualified installation/inspection when needed. A listing category, AI result, or purchase does not establish mechanical fitness.
Compatibility and lawful use
Check bike model/year, mounting standards, fasteners, dimensions, adapters, electrical ratings, and firmware requirements. Do not guess at compatibility or exceed manufacturer limits. This marketplace does not certify a modification for public-road use, vehicle registration, emissions compliance, or a particular racing rule. Users must follow applicable use and equipment laws; marketing terms such as off-road do not create an exemption.
Recalls and newly discovered defects
Sellers must check applicable manufacturer and government recall information before listing and respond to new notices. Buyers should check before installing. If you discover a recall, serious defect, injury, or credible safety concern, stop using the part, pause an eligible listing, preserve evidence, and notify Support with the listing/order reference. We can remove affected content, hold relevant funds, and coordinate necessary buyer notices and remedies. Mandatory reporting and recall duties are not replaced by AI moderation or a liability clause.
No safety certification or emergency service
Riot Racing does not physically inspect ordinary seller inventory and does not provide mechanical, medical, or emergency advice. Support is not an emergency response service. For an immediate threat, contact emergency services. Never send an unsafe product back through a carrier without approved preparation. Nothing here waives a person’s rights concerning injury, fraud, negligence, or product liability where the law protects them.
Account security and incident reporting
Email codes, authenticator protection, and what to do when something is wrong.
Email sign-in and verification
Public accounts sign in using a six-digit code sent to their email and tied to the browser that requested it. Codes expire after 10 minutes and are one use. A successful sign-in verifies mailbox control for the current session. Mailbox control is not legal identity verification, seller vetting, or proof that an item is genuine. Email-only sign-in is not an independent second factor.
Authenticator and recovery
You can add an authenticator in Account protection. Once enabled, sensitive access requires it after email verification; recovery codes can be used once. Keep your setup secret and recovery codes offline in a secure location. Staff operations require authenticator verification. Support will never ask you to send a sign-in code, authenticator secret, or recovery code in chat or email.
Session and device controls
Account sessions expire after 12 hours. Sign out on shared devices. Clear marketplace verification on all browsers through Security when needed, and also sign out of the account; those controls have different purposes. Report suspected compromise promptly. We investigate recovery requests without promising to bypass lost verification methods, and may temporarily restrict sensitive actions to protect the account.
Report a vulnerability or incident
Email riotracing23@gmail.com with “Security — Emoto Marketplace,” an affected URL, a minimal description, and a safe way to reproduce the issue using your own account. Do not access another person’s data, run destructive or high-volume tests, retain exposed information, or publish private details. Good-faith reports are welcome; this is not authorization for unauthorized access or a paid bug-bounty promise. We will assess incidents and any required notifications. No policy language substitutes for reasonable security controls.
AI listing checks and moderation appeals
What automated review does, what it cannot guarantee, and how to challenge a result.
What happens after submission
Saving a draft keeps it private. Publishing saves the listing and runs required account, content, photo-ownership, and AI checks. The AI examines listing text and uploaded photos for concrete prohibited-content and policy concerns. If all required checks complete cleanly for the current content, the listing publishes automatically without routine staff approval. Editing a listing sends it back through the required checks before it becomes public again.
Allowed photos and reasonable uncertainty
Matching screenshots, reference images, and ordinary actual-part photos are allowed when you have rights to use them and accurately describe the item. Missing logos, informal wording, unknown model numbers, ordinary wear, or a single usable photo do not alone mean a violation. Photos that cannot be screened or credible unresolved concerns can keep a listing private. Reference imagery is not evidence of the condition of the actual used part.
Limits and important decisions
AI can misunderstand an image, miss a prohibited item, or incorrectly flag a legitimate listing. A clear result means the screening found no relevant concern; it is not a safety inspection, ownership check, legal conclusion, fitment verification, authenticity certification, or promise of a successful sale. AI does not approve refunds, release money, verify carrier delivery, or decide legal rights. Staff and users must still respond to credible reports and newly discovered defects.
Corrections, retries, and human review
A flagged, uncertain, incomplete, or unavailable result leaves the listing unpublished and saved. Review the explanation, correct relevant information, and resubmit. Retry an unavailable check when offered; reasonable cooldowns, daily limits, and attempt limits apply. You may contact Support with “Moderation appeal,” the listing reference, and why the result is mistaken. A person can reconsider the evidence; no appeal deadline limits a statutory remedy. We do not promise that every appeal is immediate or that prohibited content will be approved.
Data and misuse
Listing details and photos are processed by OpenAI as described in the privacy policy. Keep private documents and personal contact information out of them. Do not hide instructions in photos or descriptions to manipulate screening, impersonate staff, or request access to another user’s information. We retain review records needed for moderation and accountability. We can revise checks and policies prospectively without representing them as flawless.
Copyright, trademarks, and content reports
Report infringing photos, copied content, counterfeits, or other rights concerns.
Your rights and permitted content
Upload only content you created or have a license, permission, or another lawful basis to use. A screenshot does not automatically grant rights to the underlying photo. Identifying a manufacturer or compatible bike does not imply affiliation. Counterfeit goods and false ownership claims are prohibited. We respond to credible notices, may restrict content while investigating, and terminate repeat infringers in appropriate circumstances while respecting legitimate disputes and lawful uses.
Send a copyright or trademark report
Email riotracing23@gmail.com with “Copyright notice — Emoto Marketplace” or “Trademark report.” Include your contact details, identification of the protected work or mark, the exact listing/page and material at issue, a description of the claimed infringement, and any relevant registration or authority information. For a copyright notice, include a good-faith statement that the challenged use is not authorized by the owner, agent, or law; a statement that your information is accurate and, under penalty of perjury, that you are the owner or authorized to act; and your physical or electronic signature. Do not send a knowingly false notice. An account is not required.
Review and information sharing
We review sufficiently specific reports and take appropriate action, which can include removing material, contacting the uploader, preserving necessary evidence, or requesting clarification. We may share relevant notice information with the affected uploader or appropriate advisers to evaluate and respond; omit unnecessary sensitive information. A listing report is not a determination by a court that infringement occurred. Trademark and counterfeit complaints may require a different analysis from copyright notices.
Counter-notices and restoration
If your content was removed because of a copyright notice and you believe this resulted from a mistake or misidentification, contact us with the removed material and its former location, your name/address/phone, signature, and a statement under penalty of perjury of that good-faith belief. A formal statutory counter-notice also includes the required consent to federal court jurisdiction and acceptance of service from the original complainant or agent. We may forward it to the complainant. Where the section 512 counter-notice process applies, restoration is generally considered within 10–14 business days after a valid counter-notice unless we receive notice of a filed court action or have a separate lawful basis to restrict the material. Seek advice if unsure; counter-notices can have legal consequences.
Designated-agent status
The email above currently receives rights reports. It is not represented as a registered DMCA designated-agent listing. Formal Copyright Office agent designation and public agent contact details must be completed by the operator before we represent that the statutory safe-harbor requirements have been met. Publishing this policy alone does not create immunity from copyright or trademark liability.
